Welcome to MEK Denim / Made Exclusively Kustom Denim (“MEK Denim,” “we,” “us,” or “our”). MEK Denim operates this website and online store, including all related information, content, features, tools, products, and services (collectively, the “Services”) to provide you with a curated shopping experience. MEK Denim is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (“Terms”), together with any policies referenced herein, describe your rights and responsibilities when you access or use the Services.

Please read these Terms carefully. They include important information about your legal rights, including warranty disclaimers and limitations of liability.

When you place an order, you are making an offer to purchase. MEK Denim reserves the right to accept or decline any order in its discretion. An order is not accepted until MEK Denim confirms acceptance, and we must receive and process payment before acceptance.

Please review your order carefully before submitting. We may be unable to accommodate cancellation requests after an order is accepted. If we do not accept, modify, or cancel an order, we will attempt to notify you using the email address, billing address, and/or phone number provided at checkout.

Purchases are subject to return or exchange solely in accordance with our Refund Policy [LINK].

You represent and warrant that purchases are for personal or household use only, and not for commercial resale or export.

SECTION 4 — PRICES AND BILLING

Prices, discounts, and promotions are subject to change without notice. The price charged will be the price shown at the time the order is placed and will be reflected in your order confirmation email. Unless otherwise stated, prices do not include taxes, shipping, handling, customs, or import charges.

Online pricing may differ from pricing offered in physical stores or through third-party channels. Separate promotional terms may apply; if promotion terms conflict with these Terms, the promotion terms control.

You agree to provide current, complete, and accurate purchase and account information and to promptly update such information as needed.

You represent and warrant that:

(i) payment information provided is true, correct, and complete;

(ii) you are authorized to use the payment method;

(iii) charges will be honored by your payment provider; and

(iv) you will pay all charges, including shipping, handling, and applicable taxes.

SECTION 5 — SHIPPING AND DELIVERY

We are not liable for shipping or delivery delays. Delivery times are estimates and not guaranteed. We are not responsible for delays caused by carriers, customs processing, or events outside our control.

Once products are transferred to the carrier, title and risk of loss pass to you.

The Services and all content included in them—including trademarks, text, displays, images, graphics, product reviews, video, audio, and the design, selection, and arrangement of the foregoing—are owned by MEK Denim, its affiliates, or licensors and are protected by U.S. and international intellectual property laws.

“MEK Denim” and related names, logos, product and service names, designs, and slogans are trademarks of MEK Denim or its licensors and may not be used without prior written permission. Shopify’s name and marks are trademarks of Shopify. All other marks are the property of their respective owners.

SECTION 7 — OPTIONAL TOOLS

We may provide access to third-party tools as part of the Services that we do not monitor or control.

You acknowledge that such tools are provided “as is” and “as available,” without warranties, representations, or conditions, and without endorsement. We are not liable for any issues arising from your use of third-party tools.

Any use of optional tools is at your own risk. You should review and approve the terms of any third-party provider before using their tools.

SECTION 8 — THIRD-PARTY LINKS

The Services may include links or embedded functionality provided by third parties. We are not responsible for the content, accuracy, or practices of third-party sites. If you leave the Services to access third-party sites, you do so at your own risk.

We are not liable for harm or damages related to your use of third-party websites or purchases made through them. Complaints regarding third-party products and services should be directed to the relevant third party.

SECTION 9 — RELATIONSHIP WITH SHOPIFY

MEK Denim is powered by Shopify, which enables us to provide the Services to you. However, all sales and purchases made in our store are made directly with MEK Denim. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of sales between you and MEK Denim, including any injury, damage, or loss resulting from purchased products and services. You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with MEK Denim.

SECTION 10 — PRIVACY POLICY

Occasionally, information on the Services may contain typographical errors, inaccuracies, or omissions related to product descriptions, pricing, promotions, offers, shipping charges, transit times, and availability.

We reserve the right to correct errors and update information or cancel orders if any information is inaccurate at any time without prior notice (including after an order is submitted).

We may terminate these Terms or your access to the Services at any time in our sole discretion without notice. You remain liable for all amounts due up to and including the date of termination.

Sections that by their nature should survive termination will survive, including Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver/Entire Agreement, Governing Law, and Privacy Policy.

Information on the Services is provided for general information only. We do not warrant accuracy, completeness, or usefulness, and any reliance is at your own risk.

EXCEPT AS EXPRESSLY STATED BY MEK DENIM, THE SERVICES AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.

SECTION 16 — LIMITATION OF LIABILITY

To the fullest extent permitted by law, MEK Denim (and its affiliates, partners, officers, directors, employees, agents, contractors, service providers, licensors, and Shopify and its affiliates) will not be liable for any direct, indirect, incidental, punitive, special, or consequential damages arising from your use of the Services or products, including lost profits, lost revenue, lost savings, loss of data, or replacement costs, whether based in contract, tort, strict liability, or otherwise, even if advised of the possibility.

These Terms and any separate agreements will be governed by the laws of the jurisdiction where MEK Denim is headquartered, without regard to conflict-of-law principles. You consent to venue and personal jurisdiction in the applicable federal and state courts.
